Ted Cruz is already demanding that the next appointment to the USSC be done by the next president, not Obama. Obama doesn't give a single fuck, and is already planning a successor.

The question is, who will congress actually approve? I mean, by definition whoever gets appointed will be more liberal than scalia, but still. Shit, maybe congress will veto everyone, that'd be an interesting standoff. 2016 is looking real interesting indeed.

The Senate can just filibuster it until the next president is elected.
Obama wants to get the successor voted cause a lot of critical votes are happening this year that will effect some of the executive actions that he has taken that Republicans are calling illegal.

Filibustering would require holding the process off for three times the average when it comes to electing a new justice, considering senators (including McConnel) have explicitly stated they will oppose any candidate of Obama's regardless we could be getting into murky territory, since that's not an actual reason to reject a candidate to the supreme court.

It'll be really interesting if Obama eventually uses an executive action to overstep congress, since they seem hell-bent on not doing their constitutional duty and appointing a new supreme court justice, and that seems to be the course of action he's been taking more and more lately, between the immigration action and the gun reform.

Immigration falls with Congress since it is part of Nationalization. Obama actually admitted that he did not have the power to do executive action on immigration in 2014. The gun control executive was stupid because he was only making some laws federal when most every single state had those laws to begin with. If you at stats gun owners have increased big time since Obama has been president.
Also some things that he is using executive action is could have been done during his first two years in office when the Democrats controlled Congress.
I am not saying that Congress is actually doing their jobs.
